OVERVIEW

This website is operated by MOMENTUM+ LTD, trading as Momentum Supplements. Throughout these Terms, “Momentum Supplements”, “Momentum+”, “we”, “us” and “our” refer to MOMENTUM+ LTD.

We provide this website, its content, products, features and related services to you. Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products.

These Terms of Service explain the conditions that apply when you browse our website, create an account or place an order with us. Our Privacy Policy, Refund Policy and Shipping Policy also form part of these Terms.

These Terms apply primarily to purchases made by consumers for personal use. If you are purchasing products for resale, wholesale or another business purpose, please contact us because separate business terms may apply.

Nothing in these Terms excludes or restricts your statutory rights under UK consumer law.

By using our website or placing an order, you agree to these Terms. If you do not agree, you should not use our website or purchase our products.

Our registered office is also our address for written correspondence and complaints unless we provide you with a different address.

SECTION 2: ELIGIBILITY, ACCOUNTS AND CUSTOMER INFORMATION

You must be at least 18 years old to place an order through our website.

When you place an order or create an account, you must provide information that is accurate, complete and current. This includes your name, email address, payment information and delivery address.

You are responsible for keeping your account details and password secure. Please contact us promptly if you believe somebody has accessed your account without permission.

We are not responsible for delivery problems caused by incorrect or incomplete information supplied by you. If you notice an error in your delivery details, contact us as soon as possible. We cannot guarantee that an address can be changed after an order has been processed or dispatched.

SECTION 3: PRODUCTS AND PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, prices, ingredients, quantities and images are accurate.

Product packaging, labels, colours and appearance may occasionally differ slightly from the images displayed online. Manufacturers may also update product packaging or formulations. Any change will not materially alter the product without being reflected in the information provided to customers where required.

Product images are for illustrative purposes and colours may appear differently depending on your screen and device settings.

Before using a product, you should read the physical label, ingredients, allergen information, directions and warnings supplied with it. If the information on the packaging appears inconsistent with the information on our website, do not use the product and contact us.

All products are subject to availability. We may withdraw products, correct descriptions or limit purchase quantities where reasonably necessary, including to manage stock, prevent fraud or prevent unauthorised resale.

We will not substitute a materially different product without your agreement.

SECTION 4: FOOD SUPPLEMENTS AND PRODUCT SAFETY

Food supplements should not be used as a substitute for a varied, balanced diet and healthy lifestyle.

You must:

• Follow the directions and recommended serving shown on the product label
• Not exceed the recommended daily amount
• Check the ingredients and allergen information before use
• Store products according to their instructions
• Keep supplements out of the reach of children

Product information and content on our website are provided for general information only. They are not medical advice and are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Individual responses to supplements and sports nutrition products vary. We do not guarantee any particular health, fitness, performance or body-composition result.

• Have known allergies or intolerances
• Are purchasing the product for somebody under 18

Nothing in this section limits our responsibility to supply products that are safe, of satisfactory quality, fit for purpose and accurately described.

SECTION 5: ORDERS AND CONTRACT FORMATION

When you submit an order, you are offering to purchase the products in your basket.

An automatic order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted it.

Your order is accepted when we send confirmation that it has been dispatched, unless we expressly confirm acceptance at an earlier stage. At that point, a contract is formed between you and MOMENTUM+ LTD.

We may decline or cancel an order before acceptance if:

• The product is unavailable
• We cannot authorise your payment
• There is an obvious pricing or product-description error
• We reasonably suspect fraud or unauthorised resale
• Delivery is not available to the address supplied
• The order would breach a legal or regulatory requirement

If payment has already been taken for an order we cannot accept, we will refund the amount paid using the original payment method.

Please check your order carefully before submitting it. If you wish to change or cancel an order, contact us promptly. We cannot guarantee that changes can be made after processing or dispatch has begun.

SECTION 6: PRICES, PAYMENT AND DISCOUNTS

All prices are displayed in pounds sterling and include applicable taxes where required.

Delivery charges are shown separately before you complete checkout. We currently deliver only to eligible United Kingdom addresses.

The total amount payable will be displayed before you confirm your order and will also be included in your order confirmation.

You confirm that you are authorised to use the payment method submitted with your order. Payment may be processed by Shopify Payments or another payment provider displayed at checkout.

If we discover an obvious pricing error before accepting an order, we may contact you to offer the correct price or cancel the affected order and issue a refund.

Promotional prices and discount codes may be subject to additional conditions, expiry dates, minimum spends, product exclusions and usage limits. Unless stated otherwise, discount codes cannot be exchanged for cash or applied retrospectively.

Only one discount may be used per order unless the checkout expressly allows discounts to be combined.

SECTION 7: SUBSCRIPTIONS

Certain Momentum+ products may be offered as recurring subscriptions. The available purchase options will be displayed on the relevant product page and at checkout.

By selecting a subscription, you authorise us and our payment provider to charge your selected payment method automatically at the frequency displayed when you subscribe. For the Momentum+ Ultimate Stack, this is normally every four weeks unless a different frequency is clearly shown before purchase.

The subscription price, any subscription discount and any applicable delivery charge will be displayed before checkout.

Your subscription continues until it is cancelled. There is no minimum subscription period unless one is clearly disclosed before you subscribe.

You can manage or cancel your subscription through the subscription-management link in your customer account or subscription emails. You may also request cancellation by emailing momentumplushq@gmail.com.

Cancellation must be completed before the next payment is processed. If a renewal payment has already been processed and the order has entered fulfilment, the cancellation will apply to future renewals. Your cancellation and return rights for the order already processed remain subject to applicable consumer law and our Refund Policy.

There is no fee for cancelling a subscription.

If we need to change a subscription price, we will provide reasonable advance notice before the new price is charged. You may cancel before the new price takes effect.

If a payment fails, we may retry the payment, contact you to update your payment method or suspend or cancel the subscription.

If a subscribed product becomes unavailable, we may delay the order, contact you about suitable options or cancel and refund the affected order. We will not replace it with a materially different product without your agreement.

We will provide any subscription reminders and cancellation rights required by applicable law.

SECTION 8: SHIPPING, DELIVERY AND RISK

Delivery dates and times are estimates unless we have expressly agreed a guaranteed delivery date.

We will deliver orders without undue delay and, unless another timeframe has been agreed, within 30 days after the contract is formed.

We remain responsible for the products until they are delivered into your physical possession or the possession of another person identified by you to receive them. Risk does not transfer to you merely because we have handed the parcel to a delivery company.

Ownership of the products passes to you once we have received payment in full and the products have been delivered.

If an order is delayed, lost or damaged during delivery, contact us as soon as possible at momentumplushq@gmail.com. We will investigate with the delivery company and provide an appropriate remedy where required.

We are not responsible for delays caused by events genuinely outside our reasonable control, but this does not remove your statutory rights where delivery is excessively delayed or does not take place.

SECTION 9: CANCELLATIONS, RETURNS AND REFUNDS

For most online purchases, you have the right to tell us that you wish to cancel within 14 days after receiving the goods. You then normally have a further 14 days to return them.

You do not need to provide a reason for exercising this right.

Certain exceptions apply. In particular, the right to cancel may not apply to sealed goods that are not suitable for return for health-protection or hygiene reasons once the seal has been broken after delivery. This may include certain opened food, supplement or sports-nutrition products.

To request a return, email momentumplushq@gmail.com before sending anything back. Include your name, order number and the product you wish to return.

Unless the item is faulty, damaged, incorrect or not as described, you are responsible for the direct cost of returning it.

Where the statutory cancellation right applies, we will refund the product price and the cost of our least expensive standard delivery option. Any additional amount paid for an enhanced delivery service does not have to be refunded.

We may reduce a refund if products have been handled beyond what is reasonably necessary to inspect them and their value has been diminished.

Refunds will normally be issued within 14 days after we receive the returned goods or receive acceptable evidence that they have been sent back, whichever occurs first.

If a product is faulty, damaged, unsafe, incorrect or not as described, contact us promptly. Your rights under the Consumer Rights Act 2015 are not affected by any provision in these Terms or our Refund Policy.

Nothing in these Terms removes your legal right to reject faulty goods or seek another remedy where applicable.

SECTION 10: WEBSITE USE AND PROHIBITED ACTIVITIES

You may use our website only for lawful purposes.

You must not:

• Use the website fraudulently or unlawfully
• Attempt to gain unauthorised access to the website, customer accounts or connected systems
• Upload or transmit viruses, malware or harmful code
• Interfere with the website’s security, performance or availability
• Collect other users’ personal information without permission
• Impersonate another person or provide deliberately false information
• Use automated systems to scrape substantial amounts of website content without permission
• Copy, reproduce or commercially exploit our website content in breach of our intellectual-property rights
• Use the website in a way that infringes another person’s rights

We may restrict or suspend access where reasonably necessary to protect customers, our business or the security of the website.

SECTION 11: INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its original content, including our branding, text, graphics, product photography, videos, designs and layout, are owned by or licensed to MOMENTUM+ LTD.

Third-party product names, images, logos and trademarks remain the property of their respective owners.

You may access and use the website for personal, non-commercial purposes. You must not reproduce, distribute, modify, publish, sell or commercially exploit protected content without permission from the relevant rights holder.

Nothing in these Terms transfers ownership of any intellectual-property rights to you.

SECTION 12: THIRD-PARTY SERVICES AND LINKS

Our website may include links to websites, applications, payment services or tools operated by third parties.

Third-party services are governed by their own terms and privacy policies. We are not responsible for the independent content or operation of third-party websites that we do not control.

You should review the relevant terms before using a third-party service or making a transaction directly with another provider.

Nothing in this section limits our responsibility for services we use to fulfil our own obligations to you.

SECTION 13: SHOPIFY

Momentum Supplements is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Momentum Supplements.

By using the Services, you acknowledge that Shopify is not the seller of the products purchased from Momentum Supplements and is not responsible for fulfilling your order.

Nothing in this section limits your rights against MOMENTUM+ LTD or any rights that cannot legally be excluded.

SECTION 14: REVIEWS AND FEEDBACK

If you submit a review, photograph, suggestion or other feedback, you confirm that:

• The content is based on your genuine experience or opinion
• You have the right to submit it
• It does not infringe another person’s rights
• You have disclosed any incentive, free product or compensation connected with it
• It is not unlawful, abusive, defamatory, misleading or fraudulent

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use submitted feedback for operating and promoting Momentum Supplements.

We may moderate or remove content that breaches these Terms, is unlawful, contains personal information or is unrelated to the product or service being reviewed. We will not remove a genuine negative review merely because it is unfavourable.

SECTION 15: WEBSITE ERRORS AND AVAILABILITY

We aim to keep our website accurate and available, but we cannot guarantee that access will always be uninterrupted or error-free.

We may correct typographical errors, product information, stock levels, delivery information or pricing where necessary.

If an error materially affects an order that has not yet been accepted, we will contact you, offer the correct information or cancel and refund the order.

Temporary website unavailability does not affect contracts we have already accepted or your statutory consumer rights.

By using our website, you acknowledge that information may be processed by Shopify, payment providers, delivery companies and other service providers where necessary to operate the store, process payments, deliver orders and meet legal obligations.

SECTION 17: OUR RESPONSIBILITY TO YOU

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Defective products where liability cannot legally be excluded
• Breach of your statutory consumer rights
• Any other liability that cannot legally be excluded or limited

Our website and products are intended for personal consumer use. If you use products for an unauthorised commercial or resale purpose, we are not responsible for business losses such as loss of profit, revenue, opportunity or business interruption, except where the law does not permit such liability to be excluded.

Nothing on our website replaces individual medical advice from an appropriately qualified healthcare professional.

SECTION 18: EVENTS OUTSIDE OUR CONTROL

We are not responsible for a failure or delay caused by an event outside our reasonable control, such as severe weather, major transport disruption, industrial action, failure of essential infrastructure, natural disaster or government restriction.

If such an event affects your order, we will take reasonable steps to minimise the delay and contact you where appropriate.

If there is a substantial delay, you may have the right to cancel the affected order and receive a refund for products that have not been supplied.

We may suspend or terminate your website account or access if you materially breach these Terms, use the website unlawfully or create a security risk.

Termination of website access does not affect:

• An order we have already accepted
• Rights and obligations that arose before termination
• Your statutory consumer rights

We may update these Terms to reflect changes to our business, website, products or legal obligations.

The Terms that apply to an individual order are normally those in effect when that order is placed. Changes will not retrospectively remove rights you already have under an accepted contract.

The current version will be published on this page with its updated date. Where required by law, we will provide additional notice of material changes.

SECTION 21: GOVERNING LAW AND DISPUTES

These Terms and contracts made through our website are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you continue to benefit from any mandatory consumer protections that apply where you live and may bring proceedings in your local courts where permitted.

SECTION 22: SEVERABILITY AND WAIVER

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any specific subscription or promotional conditions shown before purchase, form the agreement between you and us concerning your use of the website and purchases from our store.

If a specific product, subscription or promotion has additional conditions, those conditions apply alongside these Terms. If there is a direct conflict, the more specific conditions will apply to that product, subscription or promotion, subject always to applicable law.
